Version of 12 October 2026
1. Scope
These terms apply, in addition to the terms of use for buyers, to everyone who offers goods on HeimatliCH (hereinafter “seller”; persons of any gender are meant). The operator is Puya Purhemmati, Technikumstrasse 31, 9470 Buchs SG, email: [email protected] (hereinafter “HeimatliCH” or “we”). In case of conflict these seller terms prevail, as far as selling is concerned.
The privacy policy and the seller’s legal declaration and tax declaration, which you give when registering, also apply.
2. Who may sell: review and approval
- Sellers must be at least 18 years old, have legal capacity and be reachable in Switzerland or the Principality of Liechtenstein.
- Sellers must confirm their email address and mobile number, create a shop profile and submit it for review. We speak with you (for example by video call) and check whether your details are plausible. We do not ask for a copy of your ID and do not store one. We record the result of the review, the reviewer and a short note.
- We may refuse approval without giving reasons if we have the impression that the details are not correct or the requirements are not met. Approval is neither a promise nor a seal of quality. We may withdraw it at any time if there is cause.
- Listings can only be published after approval and after payment details have been stored.
3. Your listings
- You alone are responsible for your listings: title, description, photos, price, condition (“new” or “used”), quantity, handover method and shipping costs must be true, complete and not misleading.
- You may only offer goods that you have the right to sell and whose sale is permitted in Switzerland. Photos must come from you or you must be entitled to use them.
- Prices must be stated in Swiss francs. If you are subject to value added tax or sell commercially, the price must be stated including VAT (Price Disclosure Ordinance). Shipping costs must be stated separately.
- Clearly point out particularities in the listing: defects of used goods, origin, ingredients and allergens for food, age, condition, accessories.
- During the pilot phase the following goods and content are not allowed: weapons, ammunition and explosives; narcotics and medicines; spirits (distilled liquor), tobacco products and nicotine-containing products; live animals; counterfeits and pirated copies; stolen goods; goods whose sale is prohibited by law or requires a permit, if you do not have the permit; services, real estate, vehicles, securities and crypto-assets; pornographic, violence-glorifying, discriminatory or racist content.
- Wine, beer, cider and similar drinks, as well as home-made food, are allowed if you meet the obligations under food law and hospitality law (see section 8).
- We may hide or delete listings without warning if they breach these terms or the law, or if such a breach is seriously suspected.
4. How an order works
- Your listing is non-binding. A buyer’s request is a purchase offer. The purchase contract is concluded when you confirm the request. Before confirming, check whether you can deliver.
- If you do not reply within 7 days, the request lapses automatically. Only confirm requests that you can and want to fulfil.
- After your confirmation, buyer and seller see the other party’s contact details, for postal delivery you see the delivery address, and the buyer sees your payment details. Use the contact details and delivery address only for handling this order.
- The buyer pays you directly. Check your account and only confirm receipt of payment once the money has really arrived. Ship or hand over the goods only afterwards (except for cash payment on pickup) and report this on the order page.
- If the buyer does not confirm receipt, we complete the order automatically 14 days after your “shipped / handed over” report. So keep the shipping receipt.
- If no payment is reported within 14 days after your confirmation, the order is cancelled automatically and the goods are released again.
- If you cancel after confirming, do so only for good cause (for example goods no longer available). Payments already received must be refunded immediately and in full.
- Stock is reserved when a request is made and released again on rejection, cancellation or expiry. Keep your stock up to date.
5. Payment and delivery
- You provide an account at a Swiss or Liechtenstein bank (IBAN) and/or a TWINT number. The details are stored encrypted and shown only to the buyer of a confirmed order. The details must be in your name or you must be entitled to use them.
- HeimatliCH does not accept or forward money. There are no fees and no commission during the pilot phase, and the operator earns no income from the platform. You receive payment directly from the buyer.
- For postal delivery you bear the risk until the goods arrive with the buyer. Pack carefully and ship with tracking if the value justifies it. For pickup the risk passes on handover.
- You deliver within the period stated in the listing or in the messages, otherwise within a reasonable time.
6. Warranty, returns and complaints
- The statutory warranty under Art. 197 et seq. CO applies. It is in principle two years; for used items it can be shortened to one year (Art. 210 CO).
- If you want to exclude or limit the warranty, you must state this clearly in the listing. The exclusion does not apply to defects you fraudulently concealed (Art. 199 CO). As a commercial seller you can limit the warranty towards private persons only within the legal framework. If in doubt, ask a professional.
- There is no right of withdrawal or return for online purchases in Switzerland. You can voluntarily promise a right of return if you describe it in the listing. Keep your promise.
- Respond to complaints factually and promptly. If buyers report a problem through the platform, the order is put on hold. We ask both sides. If you refuse to cooperate, we can mark the order as cancelled or completed on the basis of the information available. Civil-law claims are not affected (see terms of use).
7. Messages, ratings, data protection
- The rules of the terms of use apply to messages and ratings. Links, contact details and payment details are not allowed in messages. Never ask for passwords or codes.
- Buyer data that you receive in the course of an order may only be used for handling that order. Do not use it for advertising and do not pass it to third parties, except to the shipping provider. You are yourself responsible for this data under data protection law. Delete it when retention obligations (for example for bookkeeping) have expired.
- Your shop name, postcode and town and your listings are publicly visible. Your email address, telephone number and payment details are seen only by the buyers of confirmed orders.
8. Your obligations under law, tax and social insurance
- You are yourself responsible for complying with the laws that apply to your sales. Depending on the goods this includes, for example, food legislation (notification to the cantonal food inspectorate, self-monitoring, labelling and allergen information), product safety, cantonal alcohol and hospitality law, price disclosure and fair-trading law and, for businesses, the duty to provide a legal notice.
- You must declare income from sales as taxable income. Depending on scale and regularity you count as self-employed and must register with the compensation office (AHV/OASI). From annual turnover of 100,000 francs, liability for value added tax may arise. With the tax declaration you confirm that you know these obligations and fulfil them yourself.
- If you receive benefits such as social assistance, unemployment benefit, supplementary benefits or scholarships, report your income to the competent body. If your residence status requires a permit for gainful activity, you must have it.
- HeimatliCH does not give tax or legal advice. We may be legally obliged to provide information to authorities.
9. Pilot phase, changes, termination, liability, law
- The sections “Pilot phase, availability and changes”, “Suspension and termination”, “Liability” and “Final provisions” of the terms of use for buyers apply by analogy to sellers as well. In addition:
- You can have your seller account closed at any time as soon as open orders are settled.
- You indemnify HeimatliCH against claims of third parties arising because your listings, photos or texts infringe rights of third parties or the law. This applies within what the law allows and to the extent you are at fault.
- Swiss law applies. The place of jurisdiction is Buchs SG, subject to mandatory places of jurisdiction.
- The German version is authoritative.
