Seller’s Legal Declaration

By registering as a seller on HeimatliCH, I declare the following in a binding manner:

1. Person and details

• I am at least 18 years old and have legal capacity.
• My details about myself and my shop (name, address, postcode, town, contact details, payment details) are true and complete. I will report changes without delay.
• I sell on my own account and in my own name. I do not sell on behalf of another person or company without disclosing this in the shop profile.
• The account or TWINT number given is in my name or I am entitled to use it.

2. My listings

• I only offer goods that belong to me or that I may sell, and that may lawfully be sold in Switzerland.
• I do not offer prohibited goods, in particular no weapons, narcotics, medicines, spirits, tobacco products, live animals, counterfeits or stolen goods.
• My listings are truthful and not misleading. I point out defects, particularities and, for food, ingredients and allergens.
• I hold the rights to the texts and photos I upload.

3. Obligations depending on sector and goods

• I know the legal obligations that apply to my goods (for example food, product safety, alcohol, price disclosure and fair-trading law) and comply with them. If a notification, registration or permit is needed for my activity, I have it.
• If I sell commercially, I state prices including VAT, where I am subject to VAT, and I comply with the duty to give clear details of my identity and contact address.

4. My obligations towards buyers

• I fulfil confirmed orders. I only confirm orders that I can deliver.
• I grant the statutory warranty, unless I have limited it in a permissible and clear way in the listing.
• If I cancel after payment, I refund the full amount without delay.
• I use buyers’ data only for handling the order concerned.
• I neither try to induce buyers to pay outside the platform to other accounts nor ask for passwords, codes or card details.

5. Acknowledgement

• I have understood that HeimatliCH only connects parties, is not a party to the purchase contract, does not accept money, and that the review of my person is no guarantee.
• I have read and accept the seller terms and the terms of use.
• I agree that HeimatliCH may block my account or remove my listings if I breach this declaration or the terms, or if such a breach is seriously suspected.
